CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Rajbir Singh, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Jagadhri to Sangrur. Respondent remains unrepresented despite service. It is urged before the court that certain litigation is already pending at Sangrur. Besides, applicant is unemployed and has financial constraints. She may not be able to effectively defend the proceedings pending at Jagadhri.
Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Jagadhri be transferred to a court of co-ordinate jurisdiction at Sangrur. The petition is allowed in these terms.
