**** RAMESHWAR SINGH MALIK, J. (Oral) Applicant-wife, by way of instant transfer application under Section 24 of the Code of Civil Procedure, 1908, seeks transfer of a petition under Section 9 of the Hindu Marriage Act, 1955 ('HM Act' for short), filed by the respondent-husband, from Roopnagar to Kharar. It is a matter of record that distance between Roopnagar and Kharar is only about 25 kilometers. Both the towns are well connected by roads. In this view of the matter, present one has not been found to be a fit case for ordering transfer of petition under Section 9 of the HM Act filed by the respondent-husband from Roopnagar to Kharar. Further, interest of justice also does not warrant any such transfer. In spite of the fact that two other cases are pending at Kharar, this Court is of the considered view that no case for transfer has been made out.

Dismissed.
