This is an application for disposing off the main appeal in view of the compromise dated 11.03.2024.

Learned counsel for the non-applicant/respondent Nos.1 and 2 states that she has no objection if the present application is allowed and the main case is disposed off in view of the compromise. 4.

In view of the above and for the reasons stated in the application, the same is allowed. With the consent of the learned counsel for the parties, the main appeal is taken on Board today itself. Yogesh Sharma 2024.05.31 10:51 I attest to the accuracy and integrity of this order/judgment.

Learned counsel for the parties are ad idem that the matter stands settled between the parties before the Mediation and Conciliation Centre of this Court and that in view of the compromise the appellant herein, who is the subsequent purchaser, has already compensated the plaintiffrespondent Nos.1 and 2 and in view thereof the present appeal is to be allowed and the judgment and decree passed by the First Appellate Court is to be set aside.

In view of the compromise between the parties, the present appeal is accordingly allowed. The judgment and decree of the First Appellate Court is set aside and the suit filed by the plaintiff-respondent Nos.1 and 2 is accordingly dismissed. The compromise dated 11.03.2024 is marked as Ex.C1 and be made part of the decree sheet. Decree sheet be drawn up accordingly.
