(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Kapurthala to Sangrur. It is urged before the court that certain litigation is already pending at Sangrur. Besides, applicant-wife is residing with her parents and has not source of income. Thus, it would be difficult for the applicant-wife to effectively defend the proceedings at Kapurthala. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Kapurthala be transferred to a court of co-ordinate jurisdiction at Sangrur. The petition is allowed in these terms.
