(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Sri Muktsar Sahib to Bathinda. It is urged before the court that the applicant has a minor child to look after. She has no source of income and is dependent upon her old parents. Thus, it would be difficult for the applicant-wife to effectively defend the proceedings at Sri Muktsar Sahib.
Learned counsel for the respondent submits that the respondent-husband is doing some private job in Sri Muktsar Sahib. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Sri Muktsar Sahib be transferred to a court of co-ordinate jurisdiction at Bathinda. The petition is allowed in these terms.
