Mr. Vishal Nehra, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Patiala to Ambala. It is urged before the court that certain litigation is already pending at Ambala. Applicant has one year old child to look after and she is dependent upon her old-aged parents. She has no source of income. Besides, the distance between the two places is about 80 Kms. Thus, it would be difficult for the applicant-wife to effectively defend the proceedings at Patiala.

Respondent remains unrepresented despite service. Under the facts and circumstances of the case, it is directed that the proceedings under Section 9 of the Act at Patiala be transferred to a court of co-ordinate jurisdiction at Ambala.

The petition is allowed in these terms.
