The present revision petition has been filed under Article 227 of the Constitution of India for directing the learned Additional District Judge, S.A.S. Nagar (Mohali) to expeditiously consider and adjudicate upon the application for stay (Annexure P-2).

Learned senior counsel appearing on behalf of the petitioner restricts himself to a limited prayer that the Appellate Court may be directed to expeditiously consider the application for stay (Annexure P-2). Learned senior counsel would contend that on the one hand the decree holder (DH) has been proceeded against ex parte in the appeal and he is knowingly not appearing and on the other hand the execution proceedings are continuing. Learned senior counsel would further contend that the next date before the Appellate Court concerned is 25.09.2024 and the next date fixed before the Executing Court concerned is 08.10.2024 and that the petitioner would be satisfied if a direction is given to the Appellate Court concerned to decide AMAN JAIN 2024.09.25 09:31 I attest to the accuracy and integrity of this document

Keeping in view the limited prayer made by the learned senior counsel for the petitioner, the present petition is disposed off with a request to the leaned Additional District Judge, S.A.S. Nagar (Mohali) to decide the application for stay (Annexure P-2) on the date fixed before it i.e. 25.09.2024, in accordance with law. Pending applications, if any, also stand disposed off.
