CORAM:

HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. G.S. Virk, Advocate, for Mr. G.S. Nagra, Advocate, for the applicant.

**** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Hoshiarpur to Chandigarh. It is urged before the court that certain litigation is already pending at Chandigarh. Applicant has a minor child to look after. Besides, she has no source of income and is dependent on her parents. Thus, she may not be able to effectively defend the proceedings at Hoshiarpur. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Hoshiarpur be transferred to a court of co-ordinate jurisdiction at Chandigarh. The petition is allowed in these terms.
