The petitioner is seeking regular bail in FIR No.85 dated 23.05.2025, under Section 21 of NDPS Act, 1985, registered at Police Station Mullanpur, District SAS Nagar, Mohali. 2.

Learned counsel for the petitioner contended that the petitioner has been falsely implicated in the present case. It is submitted that nothing has been recovered from him and the vehicle from which the contraband was allegedly recovered does not belong to him. The alleged recovery falls within the intermediate category. The petitioner has been in custody since 23.05.2025, i.e. for about three months. It is further submitted that the investigation has already been completed and the trial is likely to take considerable time to conclude. Hence, prayer has been made for grant of bail to the petitioner.

Mr. Sandeep Kumar, DAG, Punjab, accepts notice on behalf of the respondent-State and has placed on record the custody certificate of the petitioner along with FSL report. It is fairly admitted by learned State counsel that as per custody certificate, the antecedents of the accused reflect that he is not involved in any other criminal activity except the present case. 5.

Keeping in view of the contentions of learned counsel for the petitioner as well as learned State counsel, this Court deems it a fit case to grant the concession of regular bail to the petitioner. 6.

Accordingly, without expressing any opinion on the merits of the case, the instant petition is allowed subject to the condition that in case if any other case under the NDPS is registered against the petitioner, the respondent-State shall be at liberty to move an application for his cancellation of bail. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.
