Learned State counsel refers to para Nos.4 to 7 of the status report dated 14.11.2023 filed by Senior Superintendent of Police, District Barnala, which read thus:

" 4. That this Hon'ble Court directed the deponent to file present status report in light of Annexure P-8 i.e. Complaint of the petitioner and P-9 i.e. the pen-drive. That from the perusal of the report of Deputy Superintendent of Police, Sub-Division Barnala, District Barnala and the complete record the following points have come on record which are mentioned here in below for the kind perusal of this Hon'ble Courti. That a representation/complaint was submitted by the present petitioner before the office of the Superintendent of Police (Investigation), District Barnala and same was endorsed with No. 3350/VP dated 22.09.2023 (Annexure P8) and was further marked to Deputy Superintendent of Police, Sub-Division Barnala, District Barnala for conducting the inquiry.

ii. That it is further submitted that thereafter, Deputy Superintendent of Police, Sub-Division Barnala, District Barnala joined both the parties and conducted a detailed inquiry. That during the inquiry statements were recorded and the pen-drive which was submitted by the petitioner (Annexure P-9) was also considered.

That thereafter report vide No. 382/VP/DSB dated 26.10.2023 was submitted by the Deputy Superintendent of Police, Sub-Division Barnala, District Barnala, whereby it was stated that:- a) That the complainant Bhola Singh joined the inquiry alongwith Harpal Singh, Balvir Singh Jagal and Dara Singh got their statements recorded and submitted a pen drive consisting of one audio recording. That thereafter the other party i.e. Balbir Singh @ Lucky, Jaswinder Singh, Gurpreet Singh, Gulab Singh and Harkomal Singh, joined the inquiry and got their statements recorded. b) That thereafter on the perusal of the statements recorded during the inquiry, it was found that Bhola Singh Virk is the President of Managing Committee of Guru Gobind Singh College, Sanghera, against whom, the residents of Village Niwasi Sanghera have staged a protest regarding misuse of College funds.

c) That it was also found that the protest is being carried out in a peaceful manner on the other side of the road opposite to the College in an empty space. Balbir Singh @ Lucky and others of the opposite party are the Committee members in this protest.

d) That the complainant Bhola Singh Virk, in order to weaken the protest, met Balbir Singh @ Lucky through Jagdev Singh ex-Sarpanch resident of Karamgarh on 05.09.2023 during morning hours at New Star Dhaba near G-Mall. Where Jagdev Singh made Balbir Singh @ Lucky sit in his car and took him to the Dhaba where the complainant Bhola Singh Virk made a deal with Balbir Singh @ Lucky of an amount of Rs. 9,50,000/- in order to weaken the protest.

e) Then on 06.09.2023 in the evening hours Jagdev Singh Sarpanch took Balbir Singh @ Lucky in his car to Dana Mandi, Barnala where the complaiant Bhola Singh Virk on his own will gave Rs. 1,00,000 to Balbir Singh @ Lucky and it was promised by Bhola Singh Virk that he will give Rs. 4,00,000 on 08.09.2023 and Rs, 4,50,000 on 17.09.2023.

f) Then on 08.09.2023, the complainant Bhola Singh Virk was not able to pay Rs, 4,00,000 to Balbir Singh @ Lucky as he had promised which led to unpleasantness amongst them. Then, the audio recording of the conversation that took place between Bhola Singh Virk and Balbir Singh @Lucky was leaked by someone.

g) That it came on record during the inquiry that Jaswinder Singh and others had no clue about the conversation that took place between Bhola Singh Virk and Balbir Singh @ Lucky. It has been found that Jaswinder Singh did not go to meet the complainant Bhola Singh Virk in New Star Dhaba near G-Mall on 05.09.2023 and Dana

 CRM-M-49621-2023 (O&M) 3 Mandi Barnala on 06.09.2023 with Balbir Singh @ Lucky Neither has anything come on record that Gurpreet Singh and others of the opposite party have had any discussion with Balbir Singh @ Lucky regarding receiving money from the complainant Bhola Singh Virk.

h) Thus from the inquiry it was found that Bhola Singh Virk on his own will gave the amount to Balbir Singh @ Lucky in order to weaken the protest which was staged opposite the College premises. It has been found that Balbir Singh @ Lucky of the opposite party has not threatened or blackmailed the complainant. Therefore, no police action is required to be taken on this application and the same be consigned to record room.

iv. That thereafter the above-said report was approved by Superintendent of Police (Investigation), Barnala on 02.11.2023 and was seen and filed in accordance with law. The copy of the report of the Deputy Superintendent of Police, Sub-Division Barnala is attached herewith as Annexure R-1/T.

5. That it is humbly submitted that from the perusal of the report and the complete record it has been found that the representation ie. Annexure P-8 and the Pendrive ie. Annexure P-9 have been inquired and considered by the Deputy Superintendent of Police, Sub-Division Barnala, District Barnala during the inquiry and nothing has come on record in regard to threatening or causing mental harassment to the petitioner.

That it is further submitted that Bhola Singh Virk on his own will gave the amount to Balbir Singh @ Lucky in order to weaken the protest, which was staged opposite the College premises.

That it is pertinent to mention here that on the earlier occasion, FIR No.308 dated 06.07.2023 under Section 385, 387, 506, 120-B IPC was registered at Police Station City Barnala, District Barnala on the statement of Bhola Singh (Present Petitioner) against 1) Professor Harkamaldeep Singh 2) Professor Ranvir Varinder Singh, 3) Professor Gurpreet Kaur. 4) Professor Hardeep Kaur 5) Professor Daljit Singh. 6) Professor Raminderpal Kaur, 7) Professor Kuldeep Singh, 8) Professor Tara Singh and 9) Unknown 1.

That it is pertinent to mention here that the allegations in the complaint of the petitioner in regard to FIR No. 308 (Supra) was also related to threats and thus, action was taken in accordance with law.

7. That it is submitted that the petitioner by way of present petition is trying to put pressure upon the police to register FIR against the protestors, who are peacefully protesting against him in front of the college in order to

In view of the above, no further orders are required to be passed. 3.
