A were hiding as a result door opened and one of the boy gave blow with sharp edged weapon on her mother-in-law which hit on her head. People started gathering there. Said boys namely Monu and Amrit managed to escape. Thereafter she along with her husband Sahil took her mother-in-law to Civil Hospital, Jalandhar and then taken to Orthonova Hospital. With these allegations, present case has been registered. 3.
Learned counsel for petitioner argued that petitioner is not specifically named nor any specific role is attributed to him. Allegations levelled by the complainant are false. Petitioner is ready and willing to join the investigation. His anticipatory bail was wrongly declined by learned Sessions Judge, Jalandhar. He will abide by the terms of bail order. Therefore, his anticipatory bail application may be allowed. 4.
Bail application is opposed by learned counsel representing State. Detailed status report has been filed. It is pointed out that present petitioner is specifically named. Said occurrence was caught in CCTV footage. In the occurrence, Honey, Sahil and Rekha suffered injuries and their MLRs are on record. Present petitioner is involved in as much as 15 FIRs which are detailed in para Nos.15 of the status report. In some of the cases, he was acquitted and in other cases he was convicted. He is yet to join the investigation. Therefore, he is not entitled to be released on anticipatory bail.
CRM-M-46721-2024 -35.
I have considered the arguments and have gone through the record carefully. Facts of the case indicate that present petitioner along with co-accused entered the house of complainant at night time armed with sharp edged weapons and attacked the entire family. Present petitioner is yet to join the investigation and weapon of offence is to be recovered. Status report indicates that even prior to this occurrence he was involved in several criminal cases. Considering the specific allegations and the fact that weapon of offence is yet to be recovered, I do not find a fit case for grant of anticipatory bail and the same is, accordingly, declined.
