(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Hoshiarpur to Gurdaspur. It is urged before the court that certain litigation is already pending at Gurdaspur. Besides, the applicant has a minor daughter to look after. She has no source of income and is dependent upon her mother. Thus, it is not possible for the applicant-wife to effectively defend the proceedings at Hoshiarpur.
Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act at Hoshiarpur be transferred to a court of co-ordinate jurisdiction at Gurdaspur. The petition is allowed in these terms.
