Mohini Sharma v. Sahib Singh
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-567-2016 (O & M) Date of decision: 20.12.2016 Mohini Sharma ....Applicant V/s Sahib Singh
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. M.S. Dalal, Advocate, for the applicant.
**** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Amritsar to Ludhiana. It is urged before the court that certain litigation is already pending at Ludhiana. Besides, the distance between the two places is almost 165 Kms. She is unemployed and is dependent on her parents. Thus, it is not possible for the applicant-wife to effectively defend the proceedings at Amritsar.
Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Amritsar be transferred to a court of co-ordinate jurisdiction at Ludhiana. The petition is allowed in these terms.
