Mr. A.K. Jindal, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Bahadurgarh to Gurgaon, District Gurgaon, Haryana.
It is urged before the court that certain litigation is already pending at Gurgaon. Besides, the applicant has a two year old child to look after. She has no source of income. Thus, it is not possible for the applicant-wife to effectively defend the proceedings at Bahadurgarh. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Bahadurgarh be transferred to a court of co-ordinate jurisdiction at Gurgaon, District Gurgaon, Haryana.
The petition is allowed in these terms.
