(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Ludhiana to Jalandhar. It has been urged before the court that the petitioner has a five year old child to look after. She is employed as a Science mistress in a government school.

Plea for transfer has been opposed by learned counsel for the respondent on the ground that the trial of the case has made some headway. Evidence of the respondent has concluded.

Keeping in view the facts and circumstances of the case, I am of the considered view that no case for transfer of proceedings is made out as the trial is at an advanced stage. In the event, the applicant appears before the court, respondent shall be liable to compensate her by paying travelling/litigation expenses. He shall pay `4,000/- to the applicant on the date, she appears before the court to depose as a witness.
