(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent No.1 under Section 12 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Rupnagar to Patiala. It is urged before the court that proceedings under Section 125 Cr.P.C. are already pending at Patiala. Besides, the applicant has financial constraints. She is dependent on her parents. Respondent is stated to be serving in the army and is posted at Jaisalmer. Thus, it would not be possible for the applicant-wife to effectively defend the proceedings at Rupnagar.

Plea has been opposed by learned counsel for the respondents. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 12 of the Act at Rupnagar be transferred to a court of co-ordinate jurisdiction at Patiala. The petition is allowed in these terms.
