the trial is likely to take long time and no useful purpose would be served by keeping him behind the bars any further. It is submitted that the petitioner had applied for grant of regular bail before the learned Sessions Judge, Sirsa, which has wrongly been dismissed vide order dated 26.10.2022 (Annexure P-2). I have heard learned counsel for the parties and perused the paper book as well as the custody certificate of the petitioner handed over by learned State counsel, in Court today.
In this case, FIR No.30 dated 24.06.2022 (Annexure P-1) was registered against unknown persons. The petitioner is a young boy of around 25 years of age, at the cross roads of his career building stage and is behind the bars for the last more than seven months. The investigation in the case is complete; ( ! % # ! " ' $ -.-..A the trial is likely to take long time and no useful purpose would be served by keeping the petitioner behind bars.
Thus, without commenting on the merits of the case, petitioner-Manpreet Singh alias Mani is ordered to be released on bail subject to his furnishing of bail/surety bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, concerned. The petitioner shall appear before the police station concerned on the first Monday of every month till the conclusion of the trial and inform in writing that he is not involved in any other crime other than the case mentioned in the present order. In addition, the petitioner (or any one on his behalf) shall prepare a FDR in the sum of Rs.1,00,000/- and deposit the same with the trial Court.
-)- The same would be liable to be forfeited as per law in case of the absence of the petitioner from trial without sufficient cause. Nothing expressed here-in-above shall be construed to be an observation on merits of the case and the facts and circumstances recorded above are only for consideration of the prayer for bail at this stage. The petition is accordingly disposed of.
