CORAM:

HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Sanskar Kundu, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition under Section 24 of the Code of Civil Procedure for transfer of proceedings initiated by the respondent-husband under Section 9 of the Hindu Marriage Act, 1955 (for short 'the Act') from Samalkha to Jind.

Respondent remains unrepresented despite service. It is urged before the court that some litigation is already pending at Jind. Besides, parents of the applicant have expired and she has financial constraints. The distance between the two places is about 100 Kms. Applicant being a woman may not be able to effectively defend the proceedings at Samalkha.

Under the circumstances, the present petition is allowed. It is directed that proceedings under Section 9 of the Act at Samalkha, be transferred to a court of co-ordinate jurisdiction at Jind.
