IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-600-2016 (O & M) Date of decision: 19.12.2016 Preeti ....Applicant V/s Kishor Kumar @ Jittu
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Balkar Singh, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by the respondent-husband under Section 9 of the Hindu Marriage Act, 1955 (for short 'the Act') from the court at Patiala to Chandigarh. It is urged before the court that the applicant-wife has to look after a minor daughter. Besides, she has no source of income. Thus, it would be difficult for the applicant-wife to defend the proceedings at Patiala. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Patiala be transferred to a court of co-ordinate jurisdiction at Chandigarh. The petition is allowed in these terms.
