This is a petition under section 24 of the Code of Civil Procedure for transfer of petition initiated by respondent-husband under section 13 of the Act from the court at Moga to Bathinda. It is urged before the court that one case is already pending at Bathinda and petitioner is dependent on her parents. Due to financial constraints, she has not been able to defend the case at Moga. Besides, distance between the two places is more than 90 kms. Prayer has been opposed by learned counsel for the respondent. Keeping in view facts and circumstances of the case, petition is disposed of with the direction that proceedings pending at Moga under section 13 of the Act be transferred to a court of coordinate jurisdiction at Bathinda.
