...Respondent(s)

CORAM:

HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. D.P.S. Ahluwalia, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Ambala to Panchkula. It is urged before the court that the applicant has two minor children to look after and she is residing with her mother. There is no other male member in the family. Thus, it would be difficult for her to defend the proceedings pending at Ambala.

Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Ambala be transferred to a court of co-ordinate jurisdiction at Panchkula. The petition is allowed in these terms.
