(Oral) This is a petition under Section 24 of the Code of Civil Procedure, seeking transfer of proceedings initiated under Section 9 of the Hindu Marriage Act, 1955 (for short 'the Act') by the respondent-husband from Amritsar to Pathankot.
It is urged before the court that the petitioner has minor child to look after and she may not be able to effectively defend the proceedings at Amritsar.
Admittedly, petitioner is employed as Assistant Manager in Canara Bank, Pathankot.
Under the circumstances, I find that the petitioner would face no financial constraints in engaging a counsel for defending the proceedings at Amritsar as her personal appearance may not be required except on one or two dates. There is, thus, no ground to transfer the proceedings. Dismissed.
