...Respondent(s)

CORAM:

HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. V.K. Sandhir, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition under Section 24 of the Code of Civil Procedure seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Gurdaspur to Amritsar.

It is urged before the court that instant proceedings were initiated after applicant filed a case under Section 12 of the Domestic Violence Act at Amritsar. Besides, applicant is serving as a Teacher in Tarn Taran. It would be difficult for her to defend the proceedings effectively at Gurdaspur.

Respondent remains unrepresented despite service. Under the circumstances of the case, this petition is allowed. It is directed that proceedings under Section 9 of the Act at Gurdaspur be transferred to a court of co-ordinate jurisdiction at Amritsar.
