(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Faridabad to Fatehabad. It is urged before the court that certain litigation is already pending at Fatehabad. Besides, the distance between the two places is about 270 Kms. She is dependent upon her parents and has financial constraints. Thus, the applicant-wife would not be able to effectively defend the proceedings at Faridabad.

Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Faridabad be transferred to a court of co-ordinate jurisdiction at Fatehabad. The petition is allowed in these terms.
