Rajan Gupta, J (Oral) This is a petition seeking transfer of proceedings under Section 9 of the Hindu Marriage Act from Ludhiana to Sunam. It has been urged before this court that petitioner has no source of income. She is dependent upon her old parents. She has two minor children to look after. Certain litigation is pending at Sunam. Besides, the distance between Ludhiana and Sunam is 90 Kms. It would be difficult for her to effectively defend her case at Ludhiana.
Respondent remains unrepresented despite service. Keeping in view the facts and circumstances of the case, it is directed that the proceedings under Section 9 of the Act pending at Ludhiana be transferred to the court of coordinate jurisdiction at Sunam. Allowed in above terms.
