Shruti v. Yogesh Kumar
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-724-2016 (O & M) Date of decision: 08.12.2016 Shruti ....Applicant V/s Yogesh
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Ms. Bagyashri, Advocate, for Mr. Vinod S. Bhardwaj, Advocate, for the applicant.
**** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by the respondent-husband under Section 9 of the Hindu Marriage Act, 1955 (for short 'the Act') from the court at Rohtak to Bhiwani. It has been urged before the court that there is a distance of about 80 Kms between the two places. Certain litigation is already pending at Bhiwani. Besides, applicant has a minor child to look after. Thus, it would be not possible for her to defend the proceedings effectively at Rohtak.
Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Rohtak be transferred to a court of co-ordinate jurisdiction at Bhiwani. The petition is allowed in these terms.
