(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 13(1) of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Bathinda to Sirsa. It is urged before the court that the distance between the two places is about 120 Kms. Certain litigation is already pending at Sirsa. Besides, the applicant has two minor daughters to look after. She is dependent upon her widow mother. Thus, it would not be possible for the applicant-wife to effectively defend the proceedings at Bathinda. Respondents remain unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13(1) of the Act at Bathinda be transferred to a court of co-ordinate jurisdiction at Sirsa. The petition is allowed in these terms.
