Shally @ Sheely v. Mohit Kumar
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-729-2016 (O & M) Date of decision: 17.11.2016 Shally @ Sheely ....Applicant(s) V/s Mohit Kumar
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Gopal Singh, Advocate, for Mr. K.S. Brar, Advocate, for the applicant.
**** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Mansa to Bathinda. It is urged before the court that certain litigation is already pending at Bathinda. Besides, the applicant has a one and half year old child to look after. Thus, it would be difficult for the applicant-wife to effectively defend the proceedings at Mansa.
Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act at Mansa be transferred to a court of co-ordinate jurisdiction at Bathinda. The petition is allowed in these terms.
