(Oral) This is a petition under Section 24 of the Code of Civil Procedure for transfer of civil suit for mandatory injunction initiated by the respondent-husband from the court at Amritsar to Ludhiana. It has been urged before the court that the distance between the two places is about 150 Kms. Applicant has a minor child to look after. Besides, certain litigation is already pending at Ludhiana. The prayer has been opposed by learned counsel appearing for the respondent.
Keeping in view facts and circumstances of the case and that applicant is a woman and has a minor child aged about one and a half year, it would be appropriate if proceedings in civil suit for mandatory injunction are transferred from Amritsar to a court of co-ordinate jurisdiction at Ludhiana.
Ordered accordingly.
The petition is allowed in these terms.
