...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Ms. Satpreet Grewal, Advocate, for Mr. Rajeev K. Kapila, Advocate, for the applicant.
**** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Sangrur to Patiala. It is urged before the court that certain litigation is already pending at Patiala. Besides, the applicant has a minor child to look after. She is dependent upon her parents. Thus, the applicant-wife would not be able to effectively defend the proceedings at Sangrur. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act at Sangrur be transferred to a court of co-ordinate jurisdiction at Patiala. The petition is allowed in these terms.
