CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J. (ORAL) C.M. No.17584-C of 2016 The application for refund of court fee is allowed. The respondent-plaintiff shall be entitled for refund of the court fee of `56,395/- as affixed before the trial Court, in accordance with law. C.M. No.17583-C of 2016 and RSA No. 3989 of 2014 The prayer in the application is for deciding the main appeal in view of the compromise (Annexure A-1) arrived at between the parties. The application is allowed and the regular second appeal is dismissed as withdrawn in view of the compromise entered between the parties. The compromise (Annexure A-1) shall be made part of the record. An oral request/application is made also by the counsel appearing for the appellant-defendant for refund of the court fee. I accede to the request of the counsel for the appellant-defendant and he shall be entitled to refund of the Court fee affixed by him before the lower Appellate Court and as well as this Court in accordance with law.
