Jyoti v. Rohit Kumar
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-770-2016 (O & M) Date of decision: 23.12.2016 Jyoti ....Applicant V/s Rohit Kumar
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Vishal Aggarwal, Advocate, for Mr. Deepak Aggarwal, Advocate, for the applicant.
Mr. Sumit Puri, Advocate, for the respondent. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by the respondent-husband under Section 13 of the Hindu Marriage Act, 1955 (for short 'the Act') from the court at Sangrur to Patiala. It is urged before the court that certain litigation is already pending at Patiala. Besides, the applicant has 05 months child to look after. She is living with her brother and has no source of income. Thus, it would be difficult for the applicant-wife to defend the proceedings at Sangrur. Prayer has been opposed by the learned counsel representing the respondent.
Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act pending at Sangrur be transferred to a court of co-ordinate jurisdiction at Patiala. The petition is allowed in these terms.
