G.S.SANDHAWALIA, J. (Oral) C.M. No. 1743-CI of 2018 The main appeal is directed against the award dated 15.01.2014 of the Reference Court, Faridkot by the land owners. The appeal is also barred by 1296 days and State has opposed the condonation of delay application also by filing reply vide C.M. No. 265-CI of 2020 on the ground that no sufficient cause is made out. The said application is allowed and the reply to the application for condonation of delay is taken on record. Keeping in view the averments made that the petitioner had a health issue as such and was admitted in DMC Hospital and the appeal could not be filed in time, the application is allowed since the application is supported by affidavit.

Delay condoned.

RFA No. 704 of 2018 It is pointed out that connected RFA No. 6744 of 2014, Gurajaib Singh and others vs. State of Punjab and others and other

RFA No. 704 of 2018 (O & M) connected matters have already been decided on 13.12.2019 and the appeals of the land owners have been dismissed alongwith the State appeals. The relevant portion reads thus:- "It is in such circumstances, this Court is of the opinion that there is no merit in the State appeals to the extent where they are seeking reduction as the market value has rightly been fixed at Rs.6,67,000/- per acre nor the case is made out for enhancement. Accordingly, this Court is the opinion that the Reference Court was just and fair in fixing the market value of the land and there is no case made out for enhancement or for decreasing the amount. Resultantly, the appeals filed by both the land owners and the State are dismissed." Accordingly, the present appeal is also dismissed in the same terms.
