With the consent of learned counsel for the parties, the appeal is disposed of in following terms:- "The Appellate Court as per judgment dated 27.05.2015 will take certified copy of order dated 28.07.2014, 20.03.2015 in additional evidence; provide opportunity to the appellant to produce any evidence in rebuttal to the additional evidence and then decide the appeal at its own level on merits". The judgment passed by the Appellate Court dated 27.05.2015 is set aside to the extent that it has remanded the case to the trial Court to record the additional evidence and decided it afresh. Both the parties are directed to appear before the Appellate Court on 12.12.2018 and Appellate Court will take up the case and decide the same as per above observations, at the earliest.
