Petitioner seeks transfer of divorce proceedings under section 13 of the Hindu Marriage Act initiated by husband from Kapurthala to Tarn Taran. It has been urged before the court that three cases are already pending at Tarn Taran. Petitioner has a minor child to look after. She is dependent on her parents.
Plea has been opposed by learned counsel appearing for the respondent. He submits that respondent was assaulted by brother of the petitioner on the last date of hearing and an FIR was registered regarding the incident. He has apprehension of reoccurrence of such incident. Learned counsel for the petitioner undertakes that proceedings would go on in a peaceful manner before the court below. In view of above, proceedings pending before the court at Kapurthala under section 13 of the Act be transferred to a court of coordinate jurisdiction at Tarn Taran.
