This is a petition under section 24 of the Code of Civil Procedure for transfer of petition initiated by respondent-husband under section 13 of the Act from the court at Jind to Sonepat. It is urged before the court that petitioner has one minor son to look after who is studying at Gurgaon. According to him, petitioner has no independent source of income and is dependent on her parents. Due to financial constraints, she has not been able to defend the case at Jind. Besides, distance between the two places is more than 80 kms. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, petition is disposed of with the direction that proceedings pending at Jind under section 13 of the Act be transferred to a court of coordinate jurisdiction at Sonepat.
