Preetinder Kaur v. Harinder Singh
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-784-2016 (O & M) Date of decision: 08.12.2016 Preetinder Kaur ....Applicant V/s Harinder Singh
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Gaurav Mannan, Advocate, for Mr. Kusahgra Mahajan, Advocate, for the applicant.
**** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by the respondent-husband under Section 13 of the Hindu Marriage Act, 1955 (for short 'the Act') from the court at Pathankot to Amritsar. It is urged before the court that the distance between the two places is about 90 Kms. Certain litigation is already pending at Amritsar. Besides, applicant is dependent on her parents. Thus, it would be difficult for the applicant-wife to defend the proceedings at Pathankot. Respondents remain unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act at Pathankot be transferred to a court of co-ordinate jurisdiction at Amritsar. The petition is allowed in these terms.
