G.S.SANDHAWALIA, J. (Oral) C.M. No. 1762-CI of 2018 Application for condonation of delay of 935 days in filing the appeal against the award dated 02.07.2013 has been preferred. Keeping in view the averments made in the application duly supported by affidavit of the petitioner and the fact that there is no opposition to it by way of filing reply, the application is allowed. Delay condoned.
The appeal arises out of the award of the Reference Court, Gurgaon dated 02.07.2013 for the notification dated 27.09.2005 for the land acquired in village Bas Hariya The Reference Court, Gurgaon has placed reliance upon Ex.P-1 and earlier award dated Bhagwati Devi vs. State of Haryana to grant a sum of Rs.46,07,890/- per acre. It is not disputed that this Court in RFA No. 384 of 2013, Tej Singh & Ors. vs. State of Haryana & Ors. decided 01.06.2018 has reduced
RFA No. 718 of 2018 (O & M) the market value from Rs.46,07,890/- to Rs.43,61,400/- per acre along with all statutory benefits.
Accordingly, the present appeal is also allowed in same terms as in Tej Singh's case (supra) in favour of the appellant-Corporation. Ordered accordingly.
