Neelam v. Surender Bajaj
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-794-2016 (O & M) Date of decision: 17.11.2016 Neelam ....Applicant(s) V/s Surender Bajaj
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. P.K. Ganga, Advocate, for the applicant.
**** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 13 (1) (ia) (ib) of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Bhiwani to Sirsa. It is urged before the court that the applicant-wife has two minor children to look after. Besides, she is dependent upon her parents and has no source of income. Thus, the applicant-wife would not be able to effectively defend the proceedings at Bhiwani. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 (1) (ia) (ib) of the Act at Bhiwani be transferred to a court of co-ordinate jurisdiction at Sirsa. The petition is allowed in these terms.
