Ram Singh v. Subash & ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH Anuradha 2018.02.06 10:36 I attest to the accuracy and integrity of this document RSA-118 of 2017 (O&M) Date of Decision : 30.1.2018 RAM SINGH ....APPELLANT VS SUBASH AND OTHERS ....RESPONDENT CORAM: HON'BLE MR. JUSTICE AJAY TEWARI
Present:
Mr. S.K.Yadav, Advocate for the appellant.
**** AJAY TEWARI, J.(Oral) This appeal has been filed against the concurrent judgments of the Courts below decreeing a suit for possession on certain property which the appellant was alleged to have encroached upon. Both the Courts below primarily relied on previous demarcation to hold that there was encroachment in property since no other demarcation record or any evidence regarding adverse possession was placed on record by the appellant. Learned counsel for the appellant has not been able to show me how the reliance placed on Exhibit PW2/A (earlier demarcation record) is illegal. Consequently, the findings of the Courts below cannot be interfered with. The appeal stands dismissed. Since the main case has been decided, the pending C.M, if any, also stand disposed of.
