The present appeal pertains to the year 2019 and the same is still at the stage of preliminary hearing inasmuch as notice of motion is yet to be issued. On 27.11.2024 the following order was passed : 'On 29.07.2024 the following order was passed : "The present appeal pertains to the year 2019. Repeatedly the case has been adjourned on the request of the learned counsel for the appellant and costs were also imposed. On 02.02.2023 a request for an adjournment was made on behalf of the arguing counsel for the appellant on the ground that his father-in-law was unwell. While adjourning the case it was made clear that no further adjournment shall be granted. Yet again on 14.03.2023 time was sought by the learned counsel for the appellant to

-2argue the matter. Similarly, on 13.09.2023 and 14.02.2024, the case was adjourned on the request of the learned counsel for the appellant. Today again a request for an adjournment has been made on behalf of the arguing counsel for the appellant on the ground that he is unwell. In the interest of justice, adjourned to 27.11.2024.

It is made clear that in case the appeal is not argued on the next date of hearing, the same shall be dismissed for non-prosecution."

In view of the nature of request made, the case is adjourned to 05.12.2024.

In case the counsel is not available on the next date of hearing, let alternate arrangement be made to argue the matter. It is made clear that no further adjournment shall be granted on any account'.

Today despite the matter being called twice since morning none has put in appearance on behalf of the appellant. It appears that the appellant is not interested in pursuing the present appeal. 3.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
