HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. Rakesh Bakshi, Advocate for the petitioners. *** C.M. No. 5855-C of 2021 Mr. Manmohan Saroop, Advocate has filed vakalatnama for respondent No. 1(ii), which be taken on record. This is an application for bringing on record legal representatives of deceased respondent No. 1 Smt. Charan Kaur, mother of appellant No. 1 and respondent No. 2, who is said to have died during pendency of the present proceedings on 25.7.2020. Copy of her death certificate has been attached with the application. The application is not opposed, the same is accepted. Ranjit Singh, appellant No. 1 and Dalbir Kaur respondent No. 2 are already there on record. The amended memo of parties has been filed showing Charan Kaur to be represented by Ranjit Singh and Dalbir Kaur. Ranjit Singh cannot be appellant as well as respondent No. 1 simultaneously, as such his name is ordered to be deleted as LR of Charan Kaur mentioned at (i) since he is already there on the record as appellant No. 1.
The application stands disposed of.

RSA No. 1222 of 2017 (O&M) copy of which being Annexure A3. The compromise is between appellant Ranjit Singh and Dalbir Kaur, however, Daljit Kaur appellant No. 2 is not a party to the compromise. Learned counsel for the appellants states that she is also agreeable to the compromise and in terms of the written compromise between Ranjit Singh and Dalir Kaur, the present appeal is to be withdrawn. Learned counsel for respondent No. 2 admits the factum of appellant Ranjit Singh and his sister Dalbir Kaur having compromised the matter vide Annexure A3, which for the purpose of reference is exhibited as Ex/C1. Both the counsel agreed that the parties shall remain bound by this written compromise.
Under the circumstances, learned counsel for the appellants states that he has got instructions to withdraw the present appeal and he be permitted to do so.
Dismissed as withdraw as compromised in terms of written compromise Ex.C1.
