RSA-4110-2014 Learned counsel for the appellant seeks permission to withdraw this appeal submitting that the suit was filed claiming relief of permanent injunction against Punnu Ram, father of the appellant. During the pendency of appeal Punnu Ram, father of the appellant, has died. The relief was claimed against him in personam and after his death, there is no threat to the possession of appellant over the suit property. He further submits that Punnu Ram had also executed a Will in favour of his grand sons and the estate of Punnu Ram is to devolve as per this Will. In view of the submissions made by the learned counsel for the appellant, this appeal is dismissed as withdrawn.
