Rajan Gupta, J (Oral) This is an application under Section 24 of the Code of Civil Procedure for transfer of civil suit from Ropar to Patiala. It has been urged before this court that respondent/husband has already filed a petition under Section 9 of the Hindu Marriage Act for restitution of conjugal rights. According to him, present suit is not maintainable as Section 9 has more efficacious remedy. This court does not express any opinion on the submissions made. The petitioners are at liberty to seek appropriate remedy before the concerned court in this regard. No case is made out to invoke Section 24 of the Code of Civil Procedure for transfer of proceedings in the facts and circumstances of the case. Dismissed.
