Naresh Kumar Sanghi, J.(Oral) Prayer in this petition filed under Section 24 read with Section 151 of the Code of Civil Procedure is for transferring of the case titled "Jitender Malik vs Manju Malik" filed under Section 13 of the Hindu Marriage Act, 1955, from the board of learned Additional District Judge, Panipat to the Court of competent jurisdiction at Sonipat.

During the course of arguments the allegations and counter allegations were levelled by both the parties against

-2each other. However, better sense prevailed and both the counsel representing the parties prayed for half an hour time to seek proper instructions from their respective clients. When the case was taken up at the second time, learned counsel for the parties submit that the case mentioned hereinabove be transferred to the Court of competent jurisdiction at Rohtak. I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.

This is a matrimonial dispute between the husband and the wife. The husband has filed a divorce petition at Panipat. The wife contends that certain cases are filed by her at Sonipat, therefore, all the cases be heard and decided at one station. During course of arguments, the husband has shown his inability to go to Sonipat in view of the threat perception to him. After seeking time, learned counsel for the parties have sought instructions from their respective clients and have agreed that the case titled "Jitender Malik vs Manju Malik" pending before learned Additional District Judge, Panipat, be transferred to the Court of competent jurisdiction at Rohtak.

This Court is of the considered view that in view of the

-3position explained by learned counsel for the parties, it is expedient in the interest of justice to transfer the said case to the Court of competent jurisdiction at Rohtak.

The parties to the lis shall appear before the learned District Judge, Rohtak, on 05.08.2015, who shall either retain the case on its own board or transfer it to the Court of competent jurisdiction within the Sessions Division, Rohtak. Learned District Judge, Panipat, is directed to send complete record of the case to the Court of learned District Judge Rohtak immediately.

Disposed of.
