Usha Rani v. Kulwant Singh
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-892-2016 (O & M) Date of decision: 16.11.2016 Usha Rani ....Applicant(s) V/s Kulwant Singh
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Sanjeev Gupta, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition under Section 24 of the Code of Civil Procedure seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Panchkula to Chandigarh.
It is urged before the court that certain litigation is already pending before various courts at Chandigarh. Besides, applicant has no source of income. Thus, it will be in the interest of justice to transfer the proceedings under Section 9 of the Act to Chandigarh. I find no merit in the petition. Distance between Panchkula and Chandigarh is not much. Besides, in proceedings under Section 9 of the Act, applicant would not be required to appear before the court except on one or two dates. On such appearance, respondent-husband shall pay `2,000/- as litigation/travelling expenses to the applicant. Disposed of.
