Whether the judgment should be reported in the Digest? PARAMJEET SINGH DHALIWAL, J. (Oral) This petition has been filed under Section 24 of CPC for transfer of a civil suit titled Darshan Singh v. Rajinder Kaur pending in the Court of Civil Judge, Senior Division, SAS Nagar, Mohali. Brief facts of the case are that the respondent filed a suit for recovery of damages in which the petitioner has been summoned. Now this transfer application has been moved for transfer of the case from SAS Nagar, Mohali to Amritsar where the petitioner is residing. The only ground put forth is that she is 62 years old and has a medical problem. the son of the petitioner are working in that hospital. Be that as it may, merely on the ground of health and age, the suit cannot be transferred. The petitioner is not required to appear in the Court on each and every date of hearing. The transfer of the case will create inconvenience to the respondent/plaintiff as he will have to engage other counsel and bear the expenses for taking witnesses at that place. Dismissed.
