This is a transfer application to shift the matrimonial trial under Section 13 of the Hindu Marriage Act, 1955 from the Court of the learned District Judge, Jind to the Court of the learned District Judge, Kaithal for the reason that the petitioning wife resides in village Hajwana, District Kaithal not far from District Courts at Kaithal. Notice of motion was issued on March 27, 2015 and as per office note, the respondent-husband has been served through his brother which is accepted as due service on the husband. He has chosen not to appear or not cause appearance on his behalf and it is taken that he is not interested in contesting the case on merits.
The pleadings in the transfer application are accepted as true and correct on the principle of non-traverse and the prayer for transfer is accepted as genuine.

TA No.237 of 2015 -2Resultantly, this petition is allowed. The prayer is allowed and directions are issued under Section 24 of the Code of Civil Procedure, 1908 transferring the divorce petition from the Court at Jind to the Court at Kaithal where further proceedings shall take place. On receipt of the file, the learned District Judge, Kaithal will issue notice to the parties for appearance before him.
