NIDHI GUPTA, J. (ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.591dated 20.08.2021 (Annexure P-1) registered under Sections 365 IPC [Sections 363, 366 & 376(3) IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 were added later on] at Police Station Old Industrial, Panipat, District Panipat.

Learned counsel for the State has filed custody certificate dated 05.10.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 02 years, 01 month and 14 days.

After arguing for some time when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
