IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-44208-2025 Date of Decision: 19.08.2025 Nitish Gaur ....Petitioner

Versus

Harwinder Singh ....Respondent

CORAM:

HON'BLE MR. JUSTICE ANOOP CHITKARA

Present:

Mr. Harpreet Pal Singh Bunger, Advocate and Ms. Harnoor, Advocate for the petitioner.

***** ANOOP CHITKARA, J.

Seeking initiation of inquiry against the respondent under section 379 BNSS 2023 (formerly known as Section 340 CrPC) for making wrong statement as reflected in the order dated 19.05.2025 (Annexure P-3) passed in CRM-M-45970-2024 at the behest of petitioner in the said petition, the petitioner has come up before this Court by filing the present petition. 2.

I have heard counsel for the petitioner and gone through the relevant record to the extent to which it was required. It shall be appropriate to refer to para 4 of the order dated 19.05.2025 passed in CRM-M-45970-2024, which reads as follows:- "Petition is disposed of with the observation that in case the petitioner/complainant moves an application for cancellation of the anticipatory bail, because of violation of the terms recorded or misrepresentation of the facts same would be decided within a period of 01 week thereafter."

3.

Given above, it is not a case to initiate any action for perjury against the respondent, however in case, petitioner seeks cancellation of bail, petitioner is permitted to file application by raising all the grievances before the concerned Court. 4.

Petition is disposed of with the aforesaid observations. Pending applications, if any, stand disposed of.
